According to lawyer Irina Sivakova, a land plot received by a spouse during marriage and subsequently privatized is the joint property of both spouses. In this regard, the notary’s requirement to obtain the consent of the ex-spouse to donate this plot is justified.

However, the Supreme Court of the Russian Federation ruled that after a divorce, the notarized consent of the second spouse for transactions with common property is not required.
