Panoramic and French windows are becoming increasingly popular among apartment owners, improving the appearance and increasing natural light. However, recent court decisions in Russia have created new legal risks.
Previously, the courts believed that the window sill part of the wall was not load-bearing and did not affect common property, which made it possible to legalize redevelopments that did not violate the integrity of the building. However, the Supreme Court ruled that any interference with external walls requires the consent of all owners, including a lawsuit by neighbors and the HOA against the owner of the first floor, who expanded the window opening with a French window.
